The Supreme Court of Bangladesh is the highest court in the country and is responsible for interpreting the Constitution and ensuring the rule of law. The Supreme Court consists of two divisions: the Appellate Division and the High Court Division.
Appellate Division: The Appellate Division of the Supreme Court is the highest appellate court in Bangladesh. It primarily hears appeals from judgments and orders of the High Court Division. The Appellate Division is composed of the Chief Justice and a number of other judges, as determined by law. The Chief Justice is the head of the judiciary in Bangladesh.
High Court Division: The High Court Division of the Supreme Court has both original and appellate jurisdictions. It primarily deals with constitutional matters, writ petitions, and appeals from lower courts. The High Court Division is composed of the Chief Justice and other judges, as determined by law.
Functions and Powers of the Supreme Court:
Constitutional Interpretation: The Supreme Court has the authority to interpret the provisions of the Constitution of Bangladesh. It ensures that the laws enacted by the Parliament and the actions of the government are in compliance with the Constitution.
Judicial Review: The Supreme Court exercises the power of judicial review, which allows it to review the constitutionality of laws and actions of the government. It can strike down laws or government actions that are found to be inconsistent with the Constitution.
Appellate Jurisdiction: The Appellate Division hears appeals from judgments and orders of the High Court Division. It has the final authority to determine legal disputes and issues raised before it.
Writ Jurisdiction: The High Court Division has the power to issue writs, including habeas corpus, mandamus, prohibition, certiorari, and quo warranto.
